This page states the “Terms of Use” under which you may use this Site, which is an interactive online service operated by Genesis Counseling Center, Inc. and Genesis Assist, LLC. (“we,” “us,” or “Genesis”), consisting of information services and content provided by us and other third parties (the “Site”). These Terms of Use include the Site Privacy Policy, and they form a binding agreement between you and Genesis Counseling Center, Inc. and Genesis Assist, LLC.  By accessing or using the Site, you are agreeing to be bound by these Terms of Use and the Privacy Policy.  If you do not agree, do not use this Site.

1) Acceptable Use. This Site is intended to provide users with general information. We do not recommend or endorse any specific professionals, tests, products, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by us, our employees, others appearing on the Site at our invitation or other visitors to the Site is solely at your own risk. Your use of the Site is a privilege and not a right, and we may revoke your access at any time without notice to you.

2) Rights Reserved.

  1. Subject to your compliance with these Terms of Use, we hereby grant you a limited, revocable, non-exclusive, non-transferrable right in the United States to access and use the Site, and to view and download a single copy of the materials on the Site, in each case solely for your personal, noncommercial use. You must include the following notice in any downloaded materials: “Copyright Genesis Counseling Center, Inc.  No copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material is permitted without the express written permission of Genesis Counseling Center, Inc.”
  2. All right, title, and interest in and to the Site and the contents thereof, including, without limitation, all written content, graphical and design elements (including the Site’s “look and feel”), images, videos, audio, service marks, trademarks and logos, and all intellectual property rights therein and thereto, and all modifications to any of the foregoing (“Genesis IP”), are owned by Genesis and its licensors. Except for the limited rights granted to you in these Terms of Use, we and our licensors reserve all right, title and interest in and to all Genesis IP.

  1. The Site and all content on the Site are for informational purposes only.  Information provided through the Site does not constitute nor is it intended to be a substitute for the professional advice, judgment, treatment, or recommendations of a physician or other professional medical personnel. Information on this Site is not intended to diagnose a condition, prescribe treatment, or perform any other tasks that constitute or may constitute the practice of medicine. We make no representations or warranties whatsoever regarding the Site and any materials on the Site.  NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS OF SERVICE OR ELSEWHERE, THE SITE IS PROVIDED ON AN “AS IS” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ANY IMPLIED WARRANTY OF NON-INFRINGEMENT AND ANY IMPLIED WARRANTY OF MERCHANTABILITY. WE MAKE NO WARRANTY ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF THE SITE. The opinions expressed by the bloggers are their own and are not our opinions or endorsed by us.

We do not endorse any of such products or services, nor have we taken any steps to confirm the accuracy or reliability of any of the information contained in any third-party Sites. We do not make any representations or warranties as to the security of any information (including credit card and other personal information) users might be requested to give a third-party Site.     1. Phone numbers collected with SMS consent, will not be sold, rented, or shared with third parties or affiliates for marketing purposes under any circumstances.
    2. Consent for SMS Communication: The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
    3. Types of SMS Communications: If you have consented to receive text messages from Genesis Counseling Center, you may receive messages related to the following:
      1. Appointment reminders
      2. Follow-up messages
      3. Billing inquiries
      4. Requests for feedback
      5. Information about services, Genesis staff, etc.
    4. Message Frequency: Message frequency may vary depending on the type of communication. For example, you may receive up to 10 SMS messages per week related to your appointments, etc.
    5. Potential Fees for SMS Messaging: Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
    6. Opt-In Method: You may opt-in to receive SMS messages from Genesis Counseling Center in the following ways:
      1. Verbally, during a conversation with one of the Genesis staff
      2. On our website, during a secure webchat with one of the Genesis staff
      3. By submitting an online form
    7. Opt-Out Method: You can opt out of receiving SMS messages at any time. To do so, simply reply “STOP” to any SMS message you receive. Alternatively, you can contact us directly by phone at 929-GENESIS or by webchat on our website to request removal from our messaging list.
    8. Help: If you are experiencing any issues, you can get help directly from us by connecting with a Genesis staff member on our website using secure webchat or by calling us at 929-GENESIS.
    9. Additional Options: If you do not wish to receive SMS messages, you can choose not to check the SMS consent box on our forms.
    10. Standard Messaging Disclosures:
      1. Message and data rates may apply.
      2. You can opt out at any time by texting “STOP.”
      3. For assistance, reply “HELP” or contact us by secure webchat from our website or call us at 929-GENESIS.

4) Indemnification. You agree to defend, indemnify and hold harmless Genesis, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Site, including, without limitation, any materials you post to the Site or provide to other users. You shall promptly reimburse us for our reasonable costs (including, without limitation, our attorneys’ fees) incurred in enforcing your indemnification and defense obligations under these Terms of Use.

5) Limits of Liability.

  1. A) TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE, NOR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, WILL BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INDIRECT, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES (“NON-DIRECT DAMAGES”), OF ANY CHARACTER, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR RELATED TO THESE TERMS OF USE OR YOUR USE OF ANY SITES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  2. B) TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE LIABILITY OF US AND ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS TO YOU OR TO ANY OTHER PERSON ARISING OUT OF OR RELATED TO THESE TERMS OF USE OR YOUR USE OF ANY SITES EXCEED THE GREATER OF $100 USD OR THE FEES PAID BY YOU FOR OUR SERVICES DURING THE 12 MONTHS PRECEDING THE EVENTS THAT GIVE RISE TO YOUR FIRST CLAIM AGAINST US FOR DAMAGES.
  3. C) BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR NON-DIRECT DAMAGES, THE LIMITATIONS IN PARAGRAPH (A) ABOVE MAY NOT APPLY TO YOU, BUT IN SUCH CASE, THE LIMITATIONS IN PARAGRAPH (B) SHALL APPLY TO BOTH DIRECT AND NON-DIRECT DAMAGES.

 6) Governing Law and Jurisdiction/Waiver of Jury Trial. These Terms of Use and any claim or dispute arising out of, relating to or in connection with these Terms of Use or your use of any Site (including, without limitation, the transactions contemplated hereby), whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without giving effect to conflicts of law principles.  Each party (i) irrevocably consents and agrees that any legal action, suit or proceeding against either of them pertaining to any such claim or dispute shall be brought only in the courts of the State of Virginia located in James City County or the Federal District court for the Eastern District of Virginia, and (ii) hereby irrevocably accepts and submits to the exclusive jurisdiction of the aforesaid courts in personam, with respect to any such action, suit or proceeding. EACH PARTY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, SUIT OR PROCEEDING BROUGHT TO ENFORCE, DEFEND, OR INTERPRET ANY RIGHTS OR REMEDIES ARISING UNDER, RELATING TO OR IN CONNECTION WITH THESE TERMS OF USE OR YOUR USE OF ANY SITE.

 7) Amendment. Genesis reserves the right to change these Terms of Use in its sole and absolute discretion at any time. All changes to the Terms of Use are effective from the date posted unless a different effective date is stated in the Terms of Use. We will post notification of changes on this Site. Your continued use of the Site after the posting of any changes constitutes your acceptance of such changes. You can determine the last date upon which a change was made by referring to the “Last Updated” date at the beginning of these Terms of Use.  Please check this page regularly to determine whether there have been any updates.

8) General. If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. No waiver of any provision of these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision. All provisions of these Terms of Use, except provisions that grant you access to or use of the Site, shall survive the termination of the agreement between us and you. These Terms of Use shall be binding upon the parties, their legal representatives, successors and permitted assigns, but may not be assigned by you. Except as may be expressly stated in any other written agreement signed by you and us, these Terms of Use, including the Site Privacy Policy (as amended from time to time by us as provided in these Terms of Use) contain the entire understanding between you and us and supersede any prior agreement between you and us, whether written or oral.
